Dr. Hsiung,
I am requesting that you examine the legal aspect of your allowing statements that IMO have the potential to arrouse antisemitic feelings or anti-anyother feelings,to remain on the board after I have requested that they be deleted or addressed by you .
In particular, but not limited to, those statements that have the potential IMO for one to think that the statement is saying in some way that the jews killed Christ or that jews are loathsome, filthy or full of abominations, or the posting of what is called "replacement theology" .
The laws of some jurisdictions such as Canada and France address what they call "hate speech". Hate speech is in the criminal code of Canada and makes it a criminal offense to publicly incite hatred or willfully promote hatred to identifiable groups such as ethnic or religious groups and these laws are being more adjudicated and could be overturned , but as of now, it is my undestanding that these laws have not been overturned.
Canadian law also prohibits the internet to be used to post messages that are likely to expose a person to hatred or contempt on the basis of ethnic origin or religion.

C'mon. I already gave you a mini-seminar on American libel laws. And they boil down to simply whether a statement about someone is true or false, and whether a false statement is likely due to actual malice (deliberating printing something the publisher knows is false or "reckless disregard for the truth). The average person who feels defamed has to prove both "negligence" AND that the statement held he/she "up to public ridicule and contempt."

However, in your second paragraph, you are offering pure conjecture as to how a statement would be interpreted. Such statements are called "statements susceptible to two (or more) meanings," and NO ONE has ever won a libel case based such statements in American courts. NOT EVER. So in American legal terms (and PB does originate in America), seeking legal redress here, as you intimate, would be time-consuming and expensive and I am 100% sure you would lose. In fact, the case would likely be dismissed as without merit before it even got on the court docket.

Sorry if that's disappointing, but that's just the way First Amendment law is written in this country.

Simply put, you have no possibility of legal remedy here. You can appeal to Dr. Bob, Chief Justice of this site, to get his ruling, but that's about all you can do. Atticus

I am not presenting the material in this thread as to going toward libel law per se. The issue presented in this situation is the leaving of posts on the board that could have the potential to be illegal in Canada and other jurisdictions on the basis that the statements could have the potential to:
A. publicly incite hatred.
A2.To an identifyiable group
B. Could expose a person to hatred or contempt on the basis of ethnic origin or religion.
It is my opinion that the posts of that nature are potentially grossly offensive and could be removed by the deputy as per the FAQ.

Are you saying that the following statements that have been on posts here have more than one way to be interptreted? If so, could you post what the alternative interptetation could be? If you could , then I could have the opportunity to respond accordingly.Let us use this one as an example.

I am not seeking legal redress. It is my policy to seek redress at the lowest possible level.
I realize that going through a legal procedure to effect my requests could very well be as you write. So it is not my intent to seek legal address here. I like to reach understandings within the forum and I have done so many times here , and I believe that when I request administrative dialog that I am trying to do what I think could be good for the community as a whole.
