For people from US, now Solian can be purchased legally from a pharmacy on the internet from italy, i came accross a message that people are unfortunatelly to try because its not available in the US

It can be ordered overseas at XXXXXXXXXXXXXXXXXXXXX. Unfortunally is not approved by the FDA....

I believe the med must be FDA approved for it to be legal to import..

Please don't post/exchange information on this site that could be used to import medications into the U.S. that have not been approved by the FDA.

If you have a prescription, it;s legal to import small amounts for personal use, if the drug is not manufactured or available in the US.

It's not illegal, as long as you have a prescription, and are only buying enough of the drug for personal use.

As long as the drug is FDA approved, which Jeroen stated in his post this one was not.

Interesting. It seems that the FDA has said it wouldn't enforce existing law regarding importation of 90 days of a prescription drug not currently approved for use in the US, if, needed to treat a serious disease, and if some other additional requirements are met.

It's a bit odd to say that you're making regulations for the illegal importation of drugs, so as to make clear under what circumstances you won't prosecute the importation.

I wonder if the rule was rewritten at some point, or if it was always written so as to restrict importation to such a degree.

sorry for the smushed title.

given the level of disability, some people may have some luck asserting to possibly applicable administrative bodies that dysthymia is a serious illness.

sharing certain information under the impression that they will follow proper legal guidelines and if they are unknown, to seek them out, should at least be tried to be made okay here. i think we can find a way that this may be legally acceptable. i think this information sharing should be allowed if phrased properly. if people do not follow legal guidelines, that isn't your fault, it's theirs. i personally do not condemn certain legal breaches that are supported by logical reasoning because i know what desperation is like (i.e. like trying amisulpride, not cocaine, and honestly it is possibly very likely that there are certain accessible circumstances in the law where it is legal to try amisulpride.) but for official purposes i can't support it and i would give a sortof disclaimer to anyone i give information to in real life. if people use certain information illegally, it's their issue and legal fault, this isn't like informatively assisting suicide.

anyway, the initial post may not have been phrased properly, but i am not convinced there isn't a way it could have been, while still giving the same info.

Here's the deal: unless its a controlled substance, the FDA probably isn't going to care. Even if it is, you can probably get it into the country w/ minimal problems.

Ordering Solian or any other non-controlled substance probably won't get you into any serious trouble and odds are you can get it into the country very, very easily, as long as the seller packages the merchandise well.

I personally don't see what the big deal with Solian is, but I do think people have a right to this sort of information.

True, the Customs actions are rather cut and dried, but the FDA follow-up is discretionary, and applied on a case-by-case basis. If a treatment is unavailable in the U.S., and the treatment (i.e. imported medication) is not judged to constitute a serious risk, and the treated condition is serious, the medication will generally be allowed entry. One restriction is that the imported quantity should not exceed the amount required for 90 days treatment ....again, in the discretion of the examiner.

It's important to order supplies from a reputable source. As most medication from Europe, for example, is blister-packed and fully labelled, you're not likely to have any problems with the FDA. If a baggy of unlabelled pills comes to their attention, I'd expect a different response.

Dr. Bob has a site policy that is more restrictive than that of the FDA. That's a separate issue, and I'm grateful that this thread has been brought into compliance without punitive actions against well-meaning people.
